Shuji Hirose, owner of the independent label Soundmen on Wax Records, claims that he is the only one who has the legal rights to “Moonraker,” having purchased them when the song was released. However, Beyoncé and her team obtained a license to use the song from the song’s creator, John Holiday (also known as Foremost Poets or Johnny Dangerous), who – according to Hirose – did not even have the right to sign the relevant license! Given this, Hirose is demanding compensation for every euro that went into the coffers of Beyoncé and the record labels involved, because, as he says, he was never asked for permission for the sample.
This scenario shows how complicated the copyright process can become in today's music industry, especially when we're talking about samples from songs that were released decades ago. In an era where sampling and musical "references" are part of the creative process of every new pop hit, knowing who ultimately owns the legal rights can become a real maze.
This isn't the first time Beyoncé's name has been involved in stories about samples. We remember that the Renaissance album stood out precisely for its many samples and musical references, with other artists rejoicing (like Robin S. with "Show Me Love"), while some, like Kelis, publicly expressed their dissatisfaction with how Beyoncé's team handled the copyright issue.
In the case of “Alien Superstar,” all the spotlight falls on the intro sample. Hirose claims that he had been in agreement with Holiday since 1998 and had purchased the exclusive distribution and exploitation rights to “Moonraker” for just $1.500. So when Beyoncé’s team sought permission, it made sense to ask the creator for it – except that, legally, he no longer had the ability to sign such agreements.
The case has shaken up the industry, not so much because Beyoncé made a “serious mistake” but because the copyright space itself is full of gray areas. The result is that, once again, a chart-topping hit is becoming a public debate about the rules surrounding samples, copyright, and new forms of creation.
